Could the Rules of Property Investing Be About to Change?
For decades, residential property has been one of Australia’s favorite ways to build long-term wealth. But with a number of proposed tax reforms and tighter Australian Taxation Office (ATO) rules now in focus, investors may need to rethink some of the assumptions that have shaped property investing for years.
While several of these changes are still proposals rather than law, understanding what may be ahead can help you make more informed investment decisions.
What Changes Are Being Discussed?
There are three key developments that property investors should keep on their radar:
- Proposed changes to negative gearing for established residential properties.
- Proposed changes to Capital Gains Tax (CGT), including reducing the current 50% discount for many investors.
- New ATO rules for holiday homes, making it more difficult to claim tax deductions where a property is mainly used for personal enjoyment.
If introduced, these measures would reduce some of the tax advantages that have traditionally made investment property such an attractive wealth-building strategy.
Property values are driven by many factors, but one of the biggest is the balance between supply and demand.
If tax incentives become less attractive, some investors may decide not to purchase additional investment properties. Reduced investor demand could place downward pressure on prices in some parts of the market or, at the very least, lead to more moderate price growth than we’ve seen over recent years.
Of course, property markets are influenced by many factors including interest rates, population growth, housing supply and economic conditions, so any impact is unlikely to be uniform across Australia.
Who May Feel the Biggest Impact?
If the proposed changes proceed, they are likely to affect:
- Investors purchasing established residential properties.
- Younger Australians using “rentvesting” to enter the property market.
- Property renovators and house flippers.
- Holiday home and lifestyle property owners.
- Family trusts holding investment properties.
For many investors, the result could simply be higher after-tax holding costs and a different investment equation than in previous years.
Holiday Home Owners Should Take Note
The ATO has already introduced stricter rules around claiming deductions for holiday homes.
If a property is primarily used by the owner, family or friends, or is deliberately unavailable for rent during peak holiday periods, deductions for expenses such as:
- Mortgage interest
- Council rates
- Land tax
- Repairs and maintenance
- Depreciation may be limited or denied altogether.
If you own a holiday property, it’s worth reviewing how these rules apply to your circumstances.
Could Investors Start Looking Beyond Property?
If the tax benefits of property investing become less generous, some investors may begin exploring other opportunities that offer greater diversification and tax efficiency.
One area that continues to stand out is superannuation. While not immune from future legislative change, super remains one of Australia’s most tax-effective long-term investment structures, offering attractive concessions alongside the potential for capital growth and retirement income.
The right investment strategy, however, should never be driven by tax alone. Every investment should align with your goals, risk tolerance, time horizon and broader financial plan.
Our Perspective
Property has helped generations of Australians build wealth and we believe it will continue to play an important role in many investment portfolios.
However, investment rules evolve. That’s why it’s important to build a diversified portfolio that doesn’t rely on a single asset class or a single tax concession.
Whether these proposed changes become law or not, having a well-structured financial strategy that balances growth, income, diversification and risk is more important than ever.
